1. Acceptance of our Terms of Use. These Terms of Use ("Terms") apply to the website located at www.typesofgraffiti.com (referred to as the "Site"). The Site is owned and operated by TYPES OF GRAFFITI, LLC (referred to as the "Company" or "Types of Graffiti"). Anyone accessing or using the Site is referred to as YOU (the "User" or "You"). Please take a moment to read the complete Terms of Use. By using the Site, You accept and agree to be bound by these Terms and the Privacy Policy. If You do not agree, please refrain from accessing or using the Site. Company may change and update these Terms at any time at its discretion. All changes take effect immediately, and continued use of the Site indicates that You accept and agree to the changes. You should check this page each time You access or use the Site to stay informed of any changes, as they are binding on You.

2. Use of Site. The Site allows You to access, browse, view, communicate, shop, register, pay, and obtain Permission to Use (“License”) certain fonts, which consists of, but are not limited to: (a) typographic letters, ornamental designs, glyphs, typefaces, drawings, files and images (collectively referred to as the "Artworks"); and (b) source codes, computer codes, information, instructions, data, legends, and markings (collectively referred to as the "Programs") and all of which, when taken together (collectively referred to herein as the "Font Software").

3. Products. All Font Software products displayed through the Site represent a binding offer. By paying for a License from the Site, You accept the offer and agree to be legally bound by the terms of the License Agreement that comes with or is included with the Font Software, which governs its use.

4. Eligibility. The Site is meant for use by people living in the United States of America ("U.S.") or by non-residents who agree to use the Site and/or Font Software according to U.S. laws. When paying for a License from the Site, you acknowledge that:

(a) You are of legal age to enter into a binding agreement (which may differ based on your location);

(b) all information You provide is complete, up-to-date, truthful, and accurate; and

If Company believes You have violated any of these provisions above, License will be considered null and void, as though it had never been made, and You may not use the Font Software.

5. Property Rights. You hereby acknowledge that all Font Software products being offered within the Site are solely and exclusively owned, licensed, and controlled, by Types of Graffiti, and are protected by U.S. and international copyright, trademark, patent, trade secret and other intellectual property or proprietary right laws. Any unauthorized use is strictly prohibited. Company reserves all rights not expressly granted.

6. Prohibited Uses. With respect to the access or use of the Site, You hereby acknowledge and agree not to:

(a) violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

(b) infringe upon the copyright, trademark, or other intellectual property or proprietary rights that belong to Company;

(c) reproduce, republish, duplicate, translate, copy, distribute (including “mirroring”), or exploit any content within the Site, to any other computer, server, website or other medium for publication, distribution, or for any other commercial purposes, without Company’s express prior written consent;

(d) provide information that is false, inaccurate, misleading, or deceptive;

(e) transfer your account or share your log in credentials with any third parties;

(f) use programs, scripts, bots, spiders, scrapers, or other technology to access and extract data or content from Site; or

(g) frame, or use framing techniques to enclose any portion of the Site.

7. Payments. All transactions through the Site are handled securely by Stripe; that use SSL encryption. This payment gateway is safe and secure for using all types of credit cards and debit cards in different countries and your details are not stored during this process.

8. Online Account. Before paying for a License from the Site, You will be required to register or set up an account. Please choose a username and a password that are not easy to guess and change them often for extra safety. You are responsible for keeping your password and account login secure, as well as all actions that happen under your account. You must not share your account with anyone else at any time.

9. Delivery and Refunds. Font Software shall be delivered to You by email or other electronic means. Delivery is deemed to have occurred when the Font Software has been made available to You for download. Once delivered, Font Software may not be returned or refunded.

10. Warranty. If the delivered Font Software is found to be defective, Company will make a good faith effort to provide a fixed replacement. If the issue cannot be reasonably remedied, Company may at their discretion offer to refund You, at which point the License will immediately terminate. All claims must be made within thirty (30) days of purchase and be accompanied by the Purchase Receipt. Company makes no further warranties of any kind, either expressed or implied, including, without limitation, the implied warranties or merchantability, or fitness for a particular purpose. The entire risk arising out of use or performance of Font Software remains with You.

11. Privacy. By using the Site, You consent to the collection and use of your personal information as described in our Privacy Policy.

12. Links. Links to other websites are provided for your convenience and are not owned or managed by Company. If You decide to leave our Site through links to other websites, Company is not liable for the content or privacy practices on those sites. Company suggests that You review the privacy policies and terms of use for those websites, as they may differ from this Site.

13. Governing Law. You agree that all matters relating to the Terms of Use, Privacy Policy, or Site, will be governed by U.S. laws and brought exclusively in the federal or state courts of Miami, Florida, U.S. This applies regardless of any conflicting legal provisions, and regardless of your place of residence or where You access or use the Site.

14. Entire Agreement.. With respect to the access or use of the Site. These Terms or Use, when read together with Privacy Policy, represent the entire agreement between You and Company.
